Tosti S.r.l., with registered office in Viale Manzoni, 84/e, Ponte S. Giovanni (PG), recorded in the companies register of Perugia (n. 02930270547), is the owner of the website  https://www.tostigioielli.it/

1. The contract stipulated between Tosti S.r.l. and the Client must be understood as being concluded on the acceptance, even if only partial, of the order by Tosti S.r.l. This acceptance is deemed as tacit, unless otherwise notified in any form by the Client. By placing an order by means of the various modalities envisaged, the Client acknowledges having viewed all indications provided during the purchasing procedure and consequently, integrally accepting the payment conditions provided hereunder.

2. If the Client is a “Consumer” (i.e., an individual who purchases goods for purposes other than professional or entrepreneurial activity), once the online purchasing is concluded, they must print or save an electronic copy and, in any case, save the present general sales conditions, in compliance with the provisions of articles 3 and 4 of the Legal Decree 185/1999  on remote sales.

3. Every right of the Client to claim for compensation or indemnification or damages, as well as ascribing to same any contractual or extracontractual responsibility for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial of an order, are excluded.

4. Purchase Modalities. The Client can only purchase products present in the Tosti Jewels catalogue at the time of placing the order and that can be viewed online at the address (URL) http://www.tostijewels.com, as described in the relative information charts.

5. Upon successfully receiving an order, an order confirmation email will be sent by Tosti S.r.l. to the email address provided by the Client. This confirmation message will report the date the order was placed and a ‘Client Order Number’, to be used in any further communication with Tosti S.r.l.. The message shows all of the data entered by the Client who must check they are correct and promptly inform any corrections to be made, as described in this document.

6. If an order is not accepted, Tosti S.r.l. guarantees they will notify the Client promptly.

1. Credit Card Payments.

The Client can make payments with cards on the MasterCard, Visa, Visa Electron, Carta Aura circuits. The payment is securely made through the PayPal platform (encrypted protocol using secure http, https). It is not necessary to hold a PayPal account to make a purchase using a credit card.

a) In case of cancellation of the order, by either the Client or by Tosti S.r.l., Tosti S.r.l. will simultaneously request the cancellation of the transaction and the repayment of the money paid.

b) Tosti S.r.l. reserves the right of requesting from the Client additional information (for example a landline phone number) to determine the actual ownership of the PayPal account. In absence of the documentation requested, Tosti S.r.l. reserves the right not to accept the order.

c) At no moment in the purchasing procedure does Tosti S.r.l. have access to information relative to the purchaser’s credit card nor to other choices within the PayPal wallet. Under no circumstances can Tosti S.r.l. be held responsible for the eventual fraudulent and unlawful use of credit cards by third parties, upon payment of goods purchased on the Tosti Jewels website.

2. Advance Banking Credit Transfer.

In case of payment through Advance Banking Credit Transfer, goods ordered by the Client will be kept as allocated until proof of the credit transfer has been received, which should be sent to Tosti S.r.l. (via fax or e-mail) within and not beyond 3 working days from the date of order acceptance. The shipping of items ordered will only be fulfilled upon the effective crediting of the amount due to the Tosti S.r.l. current account, that will have to take place within and not beyond 7 working days from the date of order acceptance. Upon these due dates being exceeded, the order will be deemed as automatically cancelled. The banking credit transfer motivation will have to include:

a) the order reference number;

b) the date the order was placed;

c) the name and surname of the individual who placed the order.

3. PayPal Payments.

In the case of purchasing goods using a PayPal payment, at the conclusion of the online transaction, PayPal will immediately debit the amount of the purchase made.

a) In case of cancellation of the order, by either the Client or by Tosti S.r.l., Tosti S.r.l. will simultaneously request the cancellation of the transaction and the money paid will be refunded to the Client’s PayPal account. Refund times on the payment method selected within the PayPal account depend exclusively on PayPal and the banking system. Once the amount has been refunded to the PayPal account, under no circumstances can Tosti S.r.l. be held responsible for any eventual damages, direct or indirect, caused by delays in the effective refund which are dependent on  PayPal or by the banking system.

b) Tosti S.r.l. reserves the right of requesting from the Client additional information (for example a landline phone number) to determine the actual ownership of the PayPal account. In absence of the documentation requested, Tosti S.r.l. reserves the right not to accept the order.

c) At no moment in the purchasing procedure does Tosti S.r.l. have access to information relative to the purchaser’s credit card nor to other choices within the PayPal wallet. Tosti Jewels can accept orders with delivery within the Italian territory, as well as in the EU and Non-EU countries.

1. For orders placed on the Tosti Jewels website, Tosti S.r.l. issues an invoice that lists the items shipped, sending it via email to the person who placed the order, in compliance with art 14 of  Presidential Decree 445/2000 and Leg.Dec. 52/2004. For the issue of the invoice, the information provided by the Client at the moment of order will be used. No variation to the invoice will be possible after it has been issued.

2. The shipping and delivery costs to the client vary depending on the country of destination and the order amount:
Italy: € 9.00 for orders of less than € 200.00 (VAT included), FREE for orders over that amount
Countries within the European Union: € 40.00 for orders less than € 500.00 (VAT included), FREE for orders over that amount
Rest of the world: the costs vary depending on the country of destination and will be calculated and shown at the moment of the order. For orders over € 1,000.00 (VAT included) shipping is free.

3. Payment of the goods by the Client will take place using their chosen method at the time of order. No additional fees are due from the Client other than the total cost of the order.

5. At the moment of delivery of the goods by the courier, the Client must check that the packaging is intact, that is not damaged, wet or in any case altered, including the materials used for sealing the package (adhesive tape or metal packaging staples).

6. If goods stored in the courier’s warehouse, following repeated unsuccessful attempts to deliver them at the address provided by the Client at the time of order, are not collected within 5 days, they will be returned to Tosti S.r.l

1. In compliance with art. 5 of Leg. Dec. 185/1999, should the Client be a Consumer (i.e., an individual who purchases goods for purposes that are not referable to and outside of their professional or entrepreneurial activity or does not provide a VAT number on the order form when making the purchase from Tosti S.r.l.), they will have the right to withdraw from the purchasing contract for whatever reason, without the need to provide explanations and without any penalty being imposed.

2. In order to exercise this right, the Client will have to send Tosti S.r.l.  a notification of their wish to withdraw, within 15 working days from the date of the goods being received. This notification will have to be sent by registered post with return advice of receipt addressed to

or by means of telegram or fax always sent within the above-mentioned 10-day term, followed by notification sent by registered post with return advice of receipt, sent within the subsequent 48 hours. Once the above-mentioned notification of withdrawal has been received, Tosti Jewels Customer Service will promptly notify the Client with instructions on how to return the product, which must be received by Tosti S.r.l. within 15 days from the date of authorisation. Goods must be returned intact, complete with all their parts and in their original packaging (including bags and boxes), stored and used with reasonable diligence and care without signs of wear or dirt.

3. In any case, the right of withdrawal is subjected to the following conditions:

a) said right applies to the product purchased in its entirety, and the right to withdrawal cannot be exercised on only a part of the product purchased

b) the item purchased will have to be undamaged and returned in its original packaging, complete in all its parts (including packaging and eventual documentation and accessory supplied: manuals etc.); in order to limit damage to the original packaging, we recommend putting it into a second box; under no circumstances should stickers or adhesive tapes be directly applied to the product’s original packaging;

c) in accordance with the law, the shipping costs relative to the return of the goods are at the Client’s expense; moreover, delivery costs and any other expenses highlighted at the moment of order will not be reimbursed;

d) the goods, until certification of reception at our warehouse has been provided, will continue to be the complete responsibility of the Client;

e) in case of damage to the goods during transport, Tosti S.r.l. will notify the client of the event (within 5 working days from receiving the goods in their warehouses), to allow them to lodge a complaint against the courier that they had chosen and obtain their refund of the good’s value (if it is insured); in such an eventuality, the product will be made available for return to the Client thus simultaneously cancelling their withdrawal request;

f) Tosti S.r.l. is not responsible in any way for damages or theft/loss of goods returned by means of uninsured shipping;

g) when it arrives at the warehouse, the product will be examined to assess any damage or tampering not deriving from transport. If the original box and/or packaging is damaged, Tosti S.r.l. will deduct from the refund a percentage not exceeding 10% of the same, which will go towards repair costs.

Subject to any eventual repair costs of damages to the original packaging, Tosti S.r.l. will see to refunding the Client the full amount already paid, within 14 days starting from the date of reception of the goods, through a cancellation procedure of the amount charged to the Credit Card or by Bank Transfer. It will be the Client’s responsibility to promptly provide the bank account details through which the refund will be made. (IBAN Code – the party to whom the invoice was issued).

4. The right of withdrawal is forfeited,  should the essential condition of the goods being undamaged not be complied with (packaging and/or contents), in the cases in which Tosti S.r.l. has ascertained:

a) the product has been used without due diligence which has compromised its integrity, or the use of consumable materials;

b) the absence of the product’s original exterior and or inner packaging;

c) the absence of the product’s integral parts (accessories, manuals, …);

d) damage to the products for causes other than its transportation.

If the right of withdrawal is forfeited, the goods will remain at the Tosti S.r.l. offices, available for collection by the Client at their expense.

All of our jewels are carefully inspected and checked before each shipment. Each jewel is guaranteed for life, as well the authenticity of the precious stones and the grade of  precious metals. Each shipment is accompanied by a certificate of warranty which attests to the authenticity of the jewel purchased, and all of its main features. If any defects are found, Tosti S.r.l. must be promptly informed of them. Tosti S.r.l. will take care of the repair or replacement of the jewel for free. The warranty is voided in the case a product has been misused or tampered with.

All watches sold by Tosti S.r.l. are covered by the manufacturer’s standard warranty and against defects of conformity, in compliance with the Legislative Decree 206/05 for 24 months. Exercising the Warranty may involve requesting assistance from Authorised Service Centres present throughout the country and/or following the procedures illustrated in the documentation inside the product packaging.

If, following the intervention of an Authorised Service Centre, it is discovered that the defect or fault is not covered by the manufacturer’s standard warranty, the Client will be charged for any verification and repair costs requested by the Authorised Service Centre, as well as any transport costs, if incurred by Tosti S.r.l. .

2. Product repair times or replacement times depend solely on the manufacturer’s policies and no damages may be claimed from Tosti S.r.l. for possible delays in repairs or replacements.

The personal data required at the time of order issue are collected and processed in order to satisfy the express requests of the Client and will not in any case and for whatever reason be released to third parties. Tosti S.r.l. guarantees its Clients compliance with the normative on the subject of handling personal data, regulated by the privacy code as per Leg. Dec. 196 dated 30.06.03. The sales contract between the Client and Tosti S.r.l. is intended as stipulated in Italy and is governed by Italian Law. For the resolution of civil and penal disputes deriving from the stipulation of the present remote contract, if the Client is a “consumer”, the territorial competence is exclusively that of the court in whose precinct the Consumer has his domicile; in all other cases, the territorial competence is solely that of the Court of Perugia.
